Welcome to Bad Golf. These Terms of Service ("Terms") govern your use of the Bad Golf mobile application and web app (the "Service"), operated by Bad Golf LLC ("we," "us," or "our"). By using the Service, you agree to these Terms.

Summary — the short version

Bad Golf is a scoring calculator, not a payment processor. No real money moves through this app.
You're responsible for your own bets, your own settle-ups, and resolving disputes with your playing partners.
We provide the Service "as is" with no warranty.
Don't use the Service to break the law or hurt other people.
If you don't agree with these Terms, don't use the Service.

1. What the Service is

Bad Golf is a tool for tracking golf scores and calculating the results of golf side-bets and wagering games (skins, banker, vegas, etc.) among friends. The Service performs math. It does not move money. It does not facilitate gambling transactions.

Important: Any money owed between players based on the games tracked in Bad Golf is settled directly between those players, outside the app. We are not a party to those transactions.

2. Who can use the Service

You may use Bad Golf if:

You are at least 18 years old, OR you have permission from a parent or guardian.
You are using the Service in a jurisdiction where social wagering between friends is lawful.
You are using the Service for personal, non-commercial purposes.

You may not use the Service to operate a commercial gambling operation, broker bets between strangers, or run a sportsbook. Bad Golf is built for friendly games between people who know each other.

3. Your responsibilities

When you use Bad Golf, you agree:

To enter accurate scores and player information to the best of your ability.
To honor any debts you incur during the games tracked in the Service. We do not enforce settle-ups. You and your playing partners are responsible for paying each other.
Not to share round codes with people who shouldn't have access to that round's data. Anyone with a round code can read and edit it.
Not to enter content that is illegal, harassing, obscene, or that infringes someone else's rights.
Not to attempt to break, exploit, or reverse-engineer the Service or the underlying infrastructure.
To comply with all applicable laws in your jurisdiction.

4. Disputes between players

Bad Golf calculates outcomes based on the scores and game rules you enter. We do not arbitrate disputes between players. If you disagree with your playing partners about scores, rule interpretations, special bets, who owes who, or whether a bet was valid, that's between you and them.

If a score was entered incorrectly, anyone with the round code can correct it. If you believe a round code has been used in bad faith (e.g. by someone modifying your scores after the round), you can refuse to honor the Bad Golf calculation and resolve it with your playing partners directly.

5. Intellectual property

The Service, including all code, design, copy, and graphics, is owned by Bad Golf LLC. You may use the Service for its intended purpose. You may not copy, redistribute, modify, or create derivative works of the Service without our written permission.

Content you enter into the Service (player names, scores, course data, etc.) remains yours. By entering it, you grant us a non-exclusive license to use, store, and display it as necessary to operate the Service.

6. No warranty

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not warrant that:

The Service will be uninterrupted or error-free.
The calculations will be perfect in all edge cases.
Data you enter will never be lost, corrupted, or seen by unintended parties (round codes are short and could be guessed).
The Service will be available in your jurisdiction or compatible with your device.

7. Limitation of liability

To the maximum extent permitted by law, Bad Golf LLC will not be liable for:

Any indirect, incidental, special, consequential, or punitive damages.
Lost money in side-bets you participated in.
Disputes between you and your playing partners.
Errors in score entries, scorecard data, or calculations that you or another player entered.
Loss of access to round data if a round code is forgotten.

Our total liability to you for any claim arising from your use of the Service will not exceed the greater of (a) the amount you paid us in the 12 months prior to the claim, or (b) USD $50.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access to the Service for any user who violates these Terms, including for repeated entry of illegal content or attempts to abuse the Service.

Termination does not delete your data automatically. To request deletion of data tied to a specific round code, email us at support@badgolf.com.

9. Privacy

Our handling of information is described in our Privacy Policy. By using the Service, you also agree to that Privacy Policy.

10. Changes to the Service

We may add features, change features, or remove features at any time. We may also change pricing for any optional paid features (none exist today). Material changes will be communicated through the app or by an update to these Terms.

11. Changes to the Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date at the top. Continued use of the Service after a change constitutes acceptance.

If we make a change you don't agree with, stop using the Service.

12. Governing law and disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles.

Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Rockwall County, Texas. You consent to the jurisdiction of those courts.

You waive any right to bring claims as a class action, collective action, or representative action.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

14. Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Bad Golf LLC regarding the Service. They supersede any prior agreements.
